Tax payments do not grant land ownership under state title
In Pierre on October 7 Judge J R Hanley of Rapid City ruled that paying taxes on land where the state holds a prior title does not confer ownership. The decision ends a Pall River county case, with Attorney General MM Q Shurpe noting the court found no ten year possession transfer rights against the state. The ruling states that the statute granting ownership after ten years of possession does not apply against the state, and that claimants cannot acquire adverse interests through mere occupancy.
