Expenses Not To Be Deducted From Fines
Pierre December 20 with the exception of payment for services of undercover men costs incurred in the prosecution of liquor cases are not deductible from the amount of the fine collected by the county in the glow of Attorney General M Q Sharpe. Replying to an inquiry from R E Mundt state s attorney of Mound City the attorney general explained that there is statutory authority for the auction of compensation of special investigators if the warrant is drawn on the fund by the state's attorney accompanied by a properly itemized statement and affidavit showing the work to have been actually and necessarily incurred in securing evidence. The position that necessary expenses incurred in said action does not include expenses of trial preliminary hearing serving as process and expenses of board and transportation of a prisoner has been consistently taken by this office. We held that the remainder of the fine after payment of any fees for undercover men should be paid by the county treasurer to the state school fund.
