Great Northern Loses Tax Suit in South Dakota

The South Dakota Supreme Court upheld a 191 legislative act classifying real property into agricultural lands and other real estate for school taxation. The decision, written by Judge A B Rudolph, reverses a 1929 ruling and supports taxation under both state and federal constitutional tests. The ruling notes the classification is not arbitrary and cites federal cases allowing state tax adjustments to meet necessities.
