A defunct bank faces a receiver in court over 16 thousand dollars in unpaid claims. Officials indicate creditors file formal proofs of claim to recover funds as the institution remains in receivership.
Depositors of the Indiana National Bank stand to receive about $16,000 as Judge Anderson sustains the Master in Chancery on priority of claims against the Consolidated Paper & Bag Co. Several trustees and attorneys weigh further action with Maxon vowing to seek a higher court, though odds against approval are strong.
Mrs Katherine Roth died yesterday morning at her home 429 James street after two years of illness including two months bedridden. She was 55 years old born in Baden Germany. Survived by husband Frank one son J J Roth of Pleasant Valley and five daughters Mrs O C Rufne Mrs Scott Thomas Mrs Earle Smith Mrs Fra Garbrick and Mrs John Younes all in the city. Funeral Sunday at 3 p m at St Vincent's church with Rev Father Boeckermann. Burial will be at Catholic cemetery.
The Indiana militia may gain new arms uniforms and supplies after a discovery at the War Department in Washington shows a credit of 40 785 65 dollars. Governor Hanly can issue requisitions to obtain the equipment without delay.
J. A. Flickinger a freight brakeman sustained severe injuries to his back and body at 5 45 this morning at Walls when pinned between an engine and a freight car. He was riding the engine up a hill as it bumped a string of cars and was brought here on train No 6 and taken to his home at 720 Indiana avenue in the Stephen's ambulance.
This year promises a sparse gift season for police officers as pocket books cigars and match cases from saloonkeepers are not yet given. The usual blame for the neglect is the closing of the saloons and the general mood of abstinence.
Warren Nusbaum nine-year-old son of Mr and Mrs John Nusbaum of 712 Wolfe Avenue sustained a broken left arm above the elbow and a dislocated elbow while scuffling with another boy at the South Side school just after noon dismissal.
George Rogers pleads not guilty to a partition charge in his saloon. The trial, set for 1 o'clock this afternoon, is postponed until next Wednesday forenoon.
Postmaster Anderson's term expires January 13. The appointment of Dr. Eisenbeiss likely will not be confirmed until after the holiday adjournment when the senate meets after January 4.
Elkhart friends learn of the death of Frank Shirley’s mother who lived here until November. She was 10 years old. Mr. and Mrs. Shirley plan to return to Elkhart.
John Nolan 86, a longtime Elkhart resident and Civil War veteran, died at 9 am at his daughter Mrs. Ed Kessler’s home on St Joe Street. Born in Ireland, he lived 43 years in Elkhart, worked as a tailor, and survived by three daughters Mrs J F Dacey Duluth Minn, Mrs M W Morgan Chicago, and Mrs Ed Kessler Elkhart. Funeral plans not announced.
Mrs. Harry Ohls of Chicago died at Augustana Hospital Wednesday afternoon shortly after an operation. She was 38, born in Huntington Indiana, lived in Benton Harbor Elgin and Odell with her husband Dr. Ohls. Survived by husband two children parents two brothers and two sisters. Funeral held in Chicago at 11 this morning.
Stamp clerk P L Metzger reports a busy Christmas period with no breaks yesterday afternoon at the window. Receipts totaled about 220 dollars, far below spring days when advertisers buy in bulk. Sales ranged from two to forty cents, whereas spring customers sometimes spend hundreds. The record daily revenue at the local office was 2,680 dollars several years ago.
Defendants in liquor cases filed affidavits for a change of judge before the city court Wednesday afternoon alleging bias in the current incumbent Judge Raymer has not yet decided on appointing a special judge.
In Elkhart, Anna A. Palin was awarded $1,332.28 against Joseph A. Kinsey and Susan Kinsey in a mortgage foreclosure case. The court granted judgment for the plaintiff.

Mrs Minerva Himebaugh died after several months illness at her home one and one half miles west of New Paris at age 74.
Mrs Maria E Callison died yesterday morning in LaPorte. Funeral services will be held at 2 o'clock tomorrow afternoon.
Dr. W Moss Civil Service Examiner visited Goshen Tuesday afternoon to take statements from Postmaster Dal Sherwin and postoffice clerks about a letter found in the postmaster waste basket addressed to Mrs Sherwin. Sherwin's commission expires February 1.
Money on call loaned at 35 percent yesterday remained strong today with rates from 30 percent upward signaling continued high demand on the New York stock exchange.
Two oldest officials, Assistant Master Carpenter William Gravit and Master Blacksmith Dennis Brennan, top a pension program for faithful Elkhart railroad employees. The plan retires workers at 70 after 30 years service, granting 1 percent pension per year based on the last ten years pay. A Board of Pensions will set rules and enactment. More than 100 workers have over 20 years on the Lake Shore lines. Gravit served 55 years. Brennan over a half century remains active.
The will of Henry C. Dodge, dated April 8, 1899, directs payment of debts including a 1300 dollar debt to his son Ralph E. Dodge. It bequeaths “the elite” possessions to his wife Nancy E. Dodge and grants her broad power over real and personal property with limited court oversight. Witnesses J. S. Kiel and A. O. Rowe attest the signature.
Two Milwaukee men visited Strafford Maxon and J. W. Field to discuss securing buildings in Ek hart for a cutlery factory and a commercial college. The factory, aiming for a modest start, seeks the former American Heel Co. site, while the college would occupy the second floor of the new automobile garage at Jefferson and Maine streets.
A statement from Washington yesterday says if Congress adds a federal judge seat for Indiana the pick will come from the northern part of the state. The announcement notes the selection will be the man most suitable for the new judicial post.
Louis Kaiser a Kendalville merchant secretly wed Miss Cora Williams of Lima Ohio two weeks ago in a ceremony presided by Rev Kennedy. A slip of the tongue exposed the marriage and Kaiser confessed they will live in Kendallville.
Goshen attorney Anthony Deahl represents Strafford Maxon trustee in bankruptcy of National Mfg Co. Maxon seeks to appeal Federal Judge Andersons ruling upholding Master in Chancery Lamberts priority findings against Consolidated Paper and Bag Co. Maxon questions judging reliance on alleged false representations and has not set a date for appeal.

It chronicles settlement at Elkhart 1824 La Salle voyage near South Bend and the Lake Shore Railway history from 1852 highlighting pioneer migrations and a smooth route strategy.
Elkhart residents learn Wash Vanderlip Jr now based in New Rochelle N Y organized a company to manufacture a smoke consuming device for chimneys that passes smoke into city sewers. The firm with $300 000 capitalization has his financial backing and he reportedly gave his father shares valued at $12000.
William Stoner of Elkhart was found lying on the Big Four tracks near a railway in a drunken condition. Officer Santschi rescued him just before an oncoming train. He is jailed pending arrival of friends who promise to rescue him.
On her deathbed Miss Ruby Willis of North Manchester disclosed a secret marriage to Alva Garber last August in Coldwater Michigan after undergoing an operation for appendicitis.
Elkhart churches observed Christmas with special music, Santa Claus visits, candy for Sunday pupils, and gifts to the poor. Congregational Church held Saturday events with a Nativity program directed by Mrs. Sterling and Miss Budge. The evening featured the oratorio The New Born King by George W. Copeland, performed by a well rehearsed chorus under Mrs. Baumgartner.
The First Evangelical Church filled its sanctuary for a Sunday evening service with a Christmas arch, star and bell decorations lit by small electric lights. The Sunday school processioned from the basement to the auditorium, two choruses sang, pupils received beacon boxes, and a $21 collection went toward the church building fund. Rev. L S Fisher was given a $385 suit and Mrs Fisher a purse and quilt.
The First Christian church in Riverside held Christmas exercises Sunday night with about fifty Sunday school pupils in a cantata. Emory Arms portrayed Santa and Walter Ford played Jack Frost with few rehearsals, stepping in for an absent performer. The youngsters impressed the audience.

A stunning Christmas display at the U B Church of Northeast Elkhart impressed the crowd last evening. William Elliott earned praise for the decor effort while Mrs George Pratt again donated gifts to the infant class and the congregation. Mrs Pratt gave 58 drums and dolls to the infant class and 360 trays of candy to the church. The surprise gift of $50 to Pastor Rev Snyder was presented by Mr Pratt.
At the Methodist Protestant church a Sunday morning collection of $12 plus provisions for the poor was taken. An evergreen arch with electric lights stood as the main decoration. Evening services featured dialogues recitations and music. each pupil received candy. A $30 purse was presented to Pastor Rev. Bachman.
Five year old Vivian Hane was honored by her teacher Miss Eben Yoder for memorizing the books of the New Testament. She also earned a Bible story book for attending Sunday school throughout most of 1905.
Jesse Deacon Rush oldest Odd Fellow and Knight Templar of the city died at 5 10 this morning at 300 East Crawford after pneumonia followed a fall illness. His wife, invalid for years, remains in critical condition. Rush, 75, was born in Ducke county Ohio and lived here 45 years blacksmithing and operating a wagon shop. Survived by wife, two sons George E and Harry, a daughter Aimee, and a Seattle sister. Funeral plans await Mrs Rush recovery and word from Harry.
Julian Walters of Middlebury died yesterday in Los Angeles from consumption while there for his health. He was about 23, son of the late Charles Walters, and survived by his mother Mrs. Emeline Walters and several brothers and sisters. The remains will be brought home this week for burial.
John O Neill receives word that his brother’s son, a Nickel Plate conductor for 30 years, died last Saturday in Buchanan Michigan. He was 55, born in Hartford Connecticut, and died beneath an engine after his arm and leg were severed.
Mrs. Irvina Wagner passed away yesterday at her mother Mrs. Proline Kellett in Middlebury. The funeral is scheduled for tomorrow after services.
Miss Emily M. Kline formerly of Constantine died yesterday at her brother S. W. Kline's home in Goshen from cancer. Her death followed a period of illness.
The funeral for Dennis Kilday will be held from St Vincent church on Friday at 9 a.m. with Rev Roeckelmann officiating. The remains will be laid to rest in the Catholic cemetery.
