Supreme Court decision on mulet law in Decorah case
The Supreme Court of Towa ruled last week on a writ of certiorari seeking review of a contempt ruling against Bartel. The court held Bartel violated a perpetual injunction issued in 1804 against Frank Barth and that his storage and delivery of liquor near a railroad right of way did not constitute a public business. The building was separated from the public street by private rail property, and beer was stored and sold to customers from this cold storage storage room, constituting a violation of the statute.
