Court strikes down nuisance law in obscenity case
The Illinois Supreme Court voided a public nuisance statute used to shut a bookstore for a year over obscene materials, ruling it infringed protected speech and that milder remedies exist. Justices Clark, Miller, and Ryan differed on the ruling's severity. Kendall County had pursued numerous obscenity prosecutions 1982–85 with many cases dropped.
