Montana Supreme Court upholds mechanic lien law in Mor rigan case

The Montana Supreme Court affirmed the 1877 mechanic lien statute as valid and constitutional. It rules that any laborer or material provider on a building can claim a lien against the property, regardless of contract with the owner or actual knowledge by the owner, as long as work was performed under any authorized contract. The decision also asserts a later recorded mortgage is subordinate to such labor liens, ensuring workers are paid.
