Montana High Court Hears Challenge to Five Cent Gas Tax

The Montana Supreme Court heard 22 points attacking the act as unconstitutional and invalid, risking a $40 million highway program. W A Brown, Montana highway commission counsel, denied all points and said briefs are due in 10 days for defendants and five for plaintiffs. The law, approved by voters last June 5, would fund postwar federal aid to build 1,800 miles of highways and authorize $12 million in debenture bonds. Plaintiffs claim voters statewide lacked total voting rights and that debenture issuance should be legally regulated. Brown argued the five cent tax would remain within constitutionally allowed limits and only taxpaying voters may ballot on debt matters.
