Montana Supreme Court Rules Farm Loan Act Partial Constitutional
The Montana Supreme Court held that the farm loan act is partly constitutional and partly void. It upholds state board loans of public school and higher education funds on first mortgage to farm land, but strikes down county loan authority. The case Evans v. State Board of Land Commissioners began when Evans failed to secure a loan and sought mandamus to force loan funds. Justice Holloway wrote the opinion with full concurrence, directing immediate operation of the act.
