Judge Jere Tolton will hear a challenge to 198 voters denied ballots in the District 5 House race between James Ward and Robert Harden after a replacement machine lacked the race. Harden seeks to count those votes and potentially absentee ballots postmarked by election day amid other possible violations. Ward maintains the result stands with a lead of 39 votes and a swift resolution.
Destin will hold its first city council election on December 24 due to a 45 day post referendum rule and public notice requirements. State and local officials say the charter and Florida statute prevent shifting the date even with a special session, leaving residents urged to use absentee ballots if away for holidays.
Patricia Gould reports that Destin faces a jurisdiction gap as Okaloosa County retains authority until a new city council is seated within about 45 days. County officials fear immediate nullification of county zoning rules and permits. The governor could fill vacant seats during emergencies, while the city may delegate powers back to the county or sign intergovernmental agreements. Emergency ordinances may be passed for 90 days under charter and state law.
