Judge upholds Birmingham development ruling on density and access
Delaware County Judge Robert F. Kelly dismisses an appeal by Donald Tulloch III regarding Birmingham Township Board of Supervisors density limits on a 32 acre tract and a 48 acre Route 100 parcel. The decision upholds 15 homes on 32 acres and a 50 foot access road, and reduces second area density from 24 to 18 homes. The ruling states the PRD ordinance was properly interpreted and conditions were reasonable. The report notes the school district appeal over an exemption tied to the Dunwoody House retirement village property continues with a hearing ordered.
