Texas Supreme Court rejects bid to block Edwards Aquifer suit

The Texas Supreme Court declined to block Atty. Gen. John Hill from suing the Texas Water Quality Board over Edwards Aquifer orders. The board argued it has an adequate remedy at law and can appeal adverse judgments Hill may obtain. The suit, filed in Travis County, targets five counties including Bexar and Kinney for differing, allegedly inadequate protections and septic regulations. The board, noting its constitutional representation by the attorney general, questioned who would represent it if Hill’s suit proceeds.
