California Governor Brown says the state's 1961 anti narcotics laws remain valid despite a US Supreme Court decision striking down a narcotics addiction crime. He cites civil commitment and treatment provisions as constitutional under the new framework with six months to five years confinement plus parole and testing.
A state may impose criminal penalties for narcotics manufacture sale purchase or possession within its borders. It may also establish compulsory treatment programs to curb violations in the interest of central health and welfare, potentially removing periods of voluntary confinement and enforcing penalties for noncompliance with treatment procedures.
SACRAMENTO AP The Sacramento County District attorney plans to charge North Sacramento housewife Rosemarie Pester 22 with murder in the death of her son Dale. She admitted to police she shot and killed him and planned to kill both sons and then herself. Her husband Albert E. Pester said she called him saying I Just killed Dale and he found her kneeling on the floor trying to reload a pistol after Dale was shot. The couple's other son Keith seven wrestled with his mother as she entered his bedroom with the pistol and fired twice. A daughter Cynthia was in another room.
