Supreme Court ruling restores Powell to Congress in 1967 vote

The Supreme Court ruled the House improperly excluded Rep. Adam Clayton Powell from the 90th Congress on March 1 1967. Chief Justice Earl Warren said Powell was duly elected and not ineligible, so the House lacked power to exclude him. The decision noted Powell was seated in the 91st Congress after last fall’s election. Powell sought back pay and seniority restoration, challenging the 1967 ouster and prior fines as illegal. The vote was 7 to 1 with Justice Stewart dissenting.
