Attorney blasts SAVE tyrannny in Livermore zoning appeal

Attorney Robert Burnstein for the Associate Home Builders of the Great East Bay argues in a State Court of Appeals San Francisco reply that the SAVE ordinance is an unconstitutional land use control and an invalid attempt to curb growth. He contends zoning cannot be used to tyrannize property owners and bypass constitutional protections, citing prior Alameda County Superior Court rulings. Livermore and Pleasanton argue SAVE is a valid police power measure to protect health and welfare, not a zoning tool, with ongoing appeals after a judge ruled it unconstitutional for due process and vagueness.
