An Armstrong County coroner's jury ruled last night that no criminal negligence was evident in the death of Ethel J. Smith of New Bethlehem RD 2, who died Sept. 5 at Armstrong County Memorial Hospital. Pathologist Dr. John L. Gemperlein testified a blood clot in the abdominal cavity caused the death and could not determine the original trigger. He noted abrasions on the deceased and that husband Lowell Smith claimed they resulted from a fall, while a nurse testified she had heard the wife say she had been beaten. Witnesses described a history of violent fights between the couple, including a Sept. 2 confrontation, with drinking often involved. District Attorney Harry A. Heilman said the jury's decision does not bar any family member from filing charges.
