Allen Must Hang Governor declines to interfere in Allen case
Special to the Inter Mountain Helena Sept. 5 Governor Smith refused to commute the execution of Joseph Allen a half breed sentenced to hang for killing J 8 Reynolds in 1898. He weighed petitions but said it was not his duty to interfere while the law stood. Allen to be hanged on the scaffold used for Billy Gay, with Sheriff Davidson limiting invitations to 10 and execution between 4 am and 1 am on September 1. Ex Governor Toole resigns from the state land commission and Smith names H L Frank of Butte as successor to April 3 1905.
