Supreme Court actions mix with mine case orders
Special to the Inter Mountain Helena July 31 Marshal Crain of the supreme court moved to Butte to compel Judge Clancy to show cause why he failed to return a writ of certiorari. The Boston & Montana company seeks review of a lower court order allowing Receiver Wilson to remove a bulk head and raise the Gambetta and Piccola mines. Arguments spanned the afternoon as the court also handled a satay of execution request in Plymouth-Silver King pending appeal. Rehearings were sought in Lucey case over admissibility of evidence and a Cripple Creek arrest, with possible action before vacation. Governor Smith honored Missouri governor Stephens’s requisition for Fred Brown, wanted for grand larceny. Brown’s horse theft allegedly involved Ra Bhd and arrestee at F grado.
