Judge Lindsay Need Not Act in Mandamus Case

Special to Tater Mountain Helena Jan 28 the Montana Supreme Court quashed an alternative writ of mandamus against former Judge John Lindsay in the Boston & Montana matter. The court held a judge must sign a bill of exceptions after term if public rights are affected, but such settlement is a judicial function not subject to a mandate. Debates on supervisory control noted. Also, Judge Knowles discharged several bankruptcies including Conrad Becker and Annie Becker, and Joseph Deschamps was declared bankrupt with assets. The B Sheldon was sentenced for perjury in a land contest. The court affirmed Murray and Home Investment Land Realty v Mouldna Lumber on a title dispute connected to a valley claim.
