Injunction Sought To Halt County Local Election

Peter Elbers filed a petition before Judge Cook seeking a restraining order against the Board of Commissioners to stop a local option election. Judge Cook issued a temporary injunction delaying any election until further court order. Lawyers for Elbers argued local option law unconstitutional and that funding must come from the County Council before an election. The Board of Commissioners' attorneys moved to dissolve the injunction, with a hearing set for next Friday to decide if an election can proceed without an appropriation.
