Prescott Death Bed Will Held Invalid
Erie September 26 Judge Waite of the Orphans Court set aside the death bed will of Charles W. Prescott a wealthy Erie merchant. The decision found the will improperly executed under law though it did not rule on the sisters claims of testamentary incapacity or undue influence. The ruling clears the way for probate of a prior will naming Mary Hi and Josie Prescott of Portsmouth New Hampshire as sole beneficiaries. The earlier document drafted five years before death would have given substantial charity gifts to St Vincent’s and Hampden hospitals and to The Brie Boys Club and department store executives. The charitable gifts were struck as invalid under the 30 day rule, and the estate would then be held in trust for the sisters with remainder to the hospitals on their deaths.
