New Ruling Converts Separate Assets to Community Property
In Philadelphia a new ruling by the Internal Revenue Bureau declares that income from a husband's or wife’s separate property, including real estate and securities, is treated as community property for income tax purposes under Pennsylvania law. State Senator John W. Lord notes the ruling reverses prior guidance and aligns with the act’s intent, potentially expanding taxable income for those relying on separate investments. The Bureau’s interpretation may not affect the validity of the state law, which will be examined by the state Supreme Court next Monday.
