Judge Raps Sen Haluska Over Fifth Amendment Claim
In Pittsburgh a federal judge ruled Senator John J. Haluska had no right to Fifth Amendment protection when questioned about the Hoxsey Cancer Clinic in Portage after federal raids. The judge called Haluska's refusal to answer “a flagrant and cynical abuse” of the privilege, noting his public statements and actions. Evidence seizure involved half a million cancer pills, some compounded by Harry M. Hoxsey of Dallas. the pills are barred from interstate transport. The judge rejected the physician patient privilege argument and allowed use of the senator’s testimony. U.S. Attorney D Malcolm Anderson said he would seek an order to direct the clinic records to his office, with no current plan to question Haluska.
