Pass Plans Appeal After Sentencing
ERIE Pass plans to appeal his three counts of first degree murder conviction in the Yablonski slayings to the Pennsylvania Supreme Court immediately after Monday’s sentencing. He is to be sentenced by Erie County Judge Edward Carney at 10 am to three consecutive life terms. Defense attorney Harold Gondelman of Pittsburgh said he will seek a new trial, arguing about 30 trial errors. Prater, another union official, received three concurrent life terms earlier, with parole possible in about 12 years. The trials were moved to Erie County from Washington County after defense objections to fair juries. Gondelman, Sprague, and Pass will attend Monday’s hearing.
