Some Rules Unconstitutional Railroad Rescue Joited

A three judge panel ruled key provisions of the Regional Rail Reorganization Act unconstitutional for taking property without protecting stockholders and creditors. The decision blocks government actions to abandon or reduce service and to certify a final plan, while a split decision leaves intact the stock-for-rail assets issue. Banks and insurers with mortgages and bonds challenged the act, which envisaged ConRail and a Government National Railway Association overseeing recovery and later transfer to United Rail Corp. The panel noted Congress had not set a stock exchange plan.

Court orders seven day deadline in UC Dam ballot fight

Erie County Judge Edward H. Carney gave Attorney Thomas Ridge seven days to prove that county commissioners can place the Union City Dam Recreation project on a ballot. The suit, filed on behalf of Eileen E. Dick, Doris Gray and Vera Sayre, seeks a November refer dum and dissolution of the Erie County Parks and Recreation Authority. Ridge argues the authority duplicates the 1964 Parks Department, while Carney notes no clear official action by the full board. The dispute centers on whether the county should partner with the Army Corps of Engineers on a dam area recreation pool, with estimated county costs ranging from 19 000 to 166 000 annually over 40 years.
