Students Guilty of Conspiracy in Draft Case
In New York on June 1 a jury in federal court found Owen Cattell and Charles Phillips, former Columbia University students, guilty of conspiring to obstruct the selective draft law. The five hour deliberation included a mercy recommendation for a sentence in a forthcoming motion to set aside the verdict. The defense, led by Morris Higull, argued the verdict inconsistent with testimony. Judge Mayer Brocues scheduled further arguments Tuesday. Assistant U S District Attorney Harold A. Content contended the act was a serious invitation to repeat the offense and that the defendants, though Columbia graduates, acted with Cowardice. The judge instructed the jury that changes to the test to fit the law would nullify the prisoners.
