State Loses Bid Over Who Owns Fish In Lakes and Creeks
The Pennsylvania Superior Court ruled that the state does not own fish that are at liberty in lakes and streams. The decision upholds the notion that while the state may regulate capture sale and transport as a sovereign power it does not own the fish. The case stems from a 12 000 fish and 60 000 minnows kill near Union City traced to drainage from the GLF fertilizer plant now Agway. The state had sought civil damages in Erie County and Dauphin County courts previously, but the appellate ruling limits the state to the 1959 fish law remedy.
