Rail worker seniority suit challenges railroad rights
In BupRalo on July 20 Supreme Court Justice Clarence MacGregor reserved decision on Gore's suit seeking to restore his seniority rights. The case, termed a test to 400 railroad workers, names the Pennsylvania Railroad and the Brotherhood of Railway Trainmen and the Order of Railway Conductors along with four rivals as defendants. Gore contends a 1929 discharge violated a 1918 merger agreement restricting seniority to original divisions. He was represented by ex state Attorney General Hamilton Ward. The brotherhoods argue Gore’s seniority is intangible and the case belongs in New York State.
