The Philadelphia Plan to open construction jobs to blacks may face an early Supreme Court test. Cleveland contractor Hyman R. Weiner argues it would be reverse discrimination under the Civil Rights Act to guarantee minority hiring, as he lost a bid after refusing a manning table that would have kept most workers white. Ohio Supreme Court previously ruled against Weiner, upholding equal employment opportunities without quota guarantees.
