Bank of Italy Wins $25,000 Damage Suit in Dunkirk
Appellate Division in Rochester rules in favor of the Bank of Italy San Francisco against Merchants National Bank of Dunkirk over a dried grapes transaction. Sanesi Moran of Dunkirk and Silvia Russa of San Francisco named as real parties. The case centers on a draft guaranteed by the Dunkirk bank and a shipment of two carloads of Oldrik grapes. The Dunkirk bank was a nominal defendant as liability rests with the Sanesi Moran firm. The decision resolves a dispute over payment on the draft after grape quality issues were discovered.
