Westfield will dispute decides in Durand bequest case
In Dunkirk on December 26 a probate decision by County Surrogate Warner S. Rexford favored Miss Sarah Durand of Westfield in interpreting the will of Mrs. Marietta J Barney who died July 25 1821. Property valued around 25000 was at stake with Miss Barney’s son Frank dead a month after his mother and his heirs challenging the will’s provisions. Attorney Thomas P Heffernan argued the Durand clause intended partial bequest to Miss Barney. Ottaway and Munron opposed. A petition for construction was argued at Mayville and Rexford ruled for Miss Durand, with possible appeal.
