Landmark Kidney Donor Suit Denied by Court
In a landmark ruling Judge Hamilton Ward held that a mother who donated a kidney to save her son cannot sue the doctors who negligently removed both of the son's kidneys. The decision creates new law as medicine advances. Justice Ward noted possible future legislation to cover transplants. The plaintiff Katherine Sirianni of Lockport claimed $300,000 for health impairment. The son Carl Sirianni, also of Lockport, had previously sued for a substantial sum, with a settlement of $280,000. Defendants were Dr Wilfred M. Anna, Dr Joseph D Errico, and Dr William C. Stein, all of Lockport area. The court said the donor's action did not revive or extend the doctors' negligence. The ruling preserves the core issue: can a donor sue for negligent transplantation.
