Jamestown Obscenity Case Folds
Jamestown N Y local newsstand operator Anthony Milioto had seven month old obscenity charges dismissed in city court at the DA office request. The case followed a Feb arrest by state and local police after confiscation of about 50 paperback books from Milioto’s U S News Store amid complaints from the Jamestown Ministerial Association local clergy and residents. District Attorney Robert J Sullivan and assistant DA Robert Seydel said evidence was insufficient to proceed and Judge Lester W Berglund granted the motion to dismiss. The case drew wide interest with various groups offering aid arguing the action violated censorship norms. The books had been seized after an earlier ruling questioning seizure and the judge noted books should have been brought before the court to determine obscenity. Attorneys Michael D Lombardo and Harold P Fahringer represented Milioto. The newspaper is billed as the Shortest Distance between Customer and Store.
