Pair Convicted In Cinder Fraud State Appeals
Harrisburg attorneys for two men convicted of conspiring to cheat the Highways Department of $20,000 in Lancaster County cinder sales indicated today they would appeal the verdicts. Victor Prep, Frackville contractor, and Philip J. Price, Columbia, former highways superintendent in Lancaster County, were convicted of conspiracy yesterday by an eight woman, four man Dauphin County jury. Prep was convicted of 14 counts of false pretenses but Price was acquitted of the same counts. Trial judge Homer L. Kreider gave defense until Monday to file motions for a new trial. Both indicated they would appeal within the set time. The Commonwealth accused the men of using faked weight slips to bill the department for $10,000 worth of cinders never delivered. Both maintained innocence as the trial began last week. The jury deliberated over four hours before the verdicts. Conviction of conspiracy carries a maximum penalty of two years in prison and a $500 fine, or both. False pretense convictions carry a maximum of five years.
