Provisions of New Montana Marriage Law Explained
The 1961 Montana legislature enacted a law effective July 1 requiring a five day waiting period for marriage licenses. The period may be waived by a district court judge in cases of illness or other special need. The application must identify both parties and include sworn statements of eligibility, ages, locations, and parents and guardians. If no legal objection exists within five days, the clerk issues the license.
