Judge Bourquin Rules Prescription Liquor Limit Unconstitutional
In Helena a federal judge ruled Congress cannot limit doctors prescriptions for alcohol. Judge George M. Bourquin said physicians control medical treatment and the limit on prescriptions or amounts violates physician and patient rights. The case involved Dr. J. B. Freund of Butte charged with issuing over 100 whiskey prescriptions in 90 days. The decision drops the prosecution and expands individual rights beyond a New York ruling.
