Proving Up on Coal Land Act Approved in 1909
The act passed by Congress allows entrymen who located or entered nonmineral lands later found valuable for coal to obtain patents with a Reservation of coal rights to the United States. Coal on such lands may be disposed of under coal land laws, with consent required to mine, and damages secured by a court. Prior to disposal, the owner may mine for domestic use. Final proof by qualified entrants entitles them to patents without reservation unless the land is chiefly coal.
