Ohio Court of Appeals rules railroads must notify shipper on consignee failure
The Ohio Court of Appeals First District holds railroads must notify the shipper when a consignee or notified party refuses to accept shipments. The Bever Company of Gentry, Arkansas shipped apples to Herier & Co in Cincinnati in 1919. After arrival, shipment was inspected and declined by Herier, and the car was later seized and the apples sold. The court rejected the notion that notice to the designated party in the bill of lading relieves the railroad of notifying the shipper. It affirmed that the carrier must use due diligence to notify the shipper of refusal by the consignee or third party.
