Polygamous Wife Barred From Land Entry, Interior Finds

Acting Secretary Bell rules in Lyons v Stevens that a first wife in a polygamous arrangement may obtain title to 160 acres only if she ends the illegal relation. A second wife cannot claim land, and the husband cannot misuse homestead or preemption laws through polygamous control. If the wife repudiates the relation, she may gain rights, but ongoing polygamy disqualifies entry.
