Power Case Advances Toward Supreme Court Review
The New River case on the federal water power act moves to the U S circuit court of appeals in Asheville N C for argument. The Federal Power Commission argues federal jurisdiction over the 21 million dollar Appalachian Electric Power project at Radford VA along the Kanawha and New rivers, with Virginia as an intervener. The outcome could affect federal regulation of non navigable waterways and future hydro projects. Huston Thompson leads for the government and Newton B Baker for Appalachian Power.
