Law Challenged By State Convict
MOUNDSVILLE June 18. A state penitentiary inmate challenged the constitutionality of a West Virginia act that lengthened his three year term to 10 years. In a habeas corpus petition J F Shreve of Pocatello county attacked the indeterminate sentence law and the director of probation and parole determining the actual term. The department explained some courts had kept exact sentences but under an attorney general ruling those terms extend to prisoners already confined. About 300 inmates with existing exact terms could have sentences changed. The action, joined by two others, will come before acting Circuit Judge Everett F Moore tomorrow. Moore said one other petitioner would remain anonymous due to technicalities. The third action, by W N Stroup, a life termer from McDowell county, was also filed.
