Fidelity Case Stay Rejected in Federal Court Proceeding
Former receivers of the Fidelity Assurance association of Wheeling lost their bid to stay a federal court order naming the Central Trust company of Charleston as trustee. Judge Ben Moore overruled the request, citing potential delay harming trustee duties and asset management outside the state. The case involves Kanawha County court trustees Smith and Thomas and questions venue jurisdiction and asset scope under bankruptcy law. A related note links Wellington egg fears to farmers storing eggs for higher prices amid a New Zealand inquiry demand.
