The Supreme Court postponed announcing its ruling on the gold clause cases delaying the decision to February 11. Chief Justice Hughes ordered the court clerk to announce the court is not yet ready to issue a verdict, amid market suspense and Roosevelt program considerations.
Washington on February 2, United Mine Workers chief Joan L. Lewis accused Donald R. Richberg, the lend's secovery coordinator, of treachery toward organized labor and blamed him for Roosevelt administration support of a 40 hour week in the automobile code. Lewis criticized DuPont and General Motors as unsupportive of the 40 hour week and denounced Richberg for implying knowledge of labor issues. William Green, AFL president, said the remarks reflected federation sentiment, and Green planned to press the White House within ten days over a delay in codifying the cigarette workers union. The AFL executive council ordered Green to pursue action after protest against influence in labor matters.
In Baton Rouge Huey P Long postponed the murder plot inquiry after witness George Davis testified a $20 000 reward for Longs head was offered. Davis, a former deputy sheriff, described several assassination attempts as Long remained guarded by National Guards and private bodyguards.
Governor Kump proposes increased appropriations for public safety, health departments and the conservation commission, plus 250000 for a medium security prison to be built by prison labor. He backs a net income tax bill and hints at repealing or amending the gross income tax, with legislature to refine measures.
Richmond police captured seven members alleged to head a Georgia outlaw gang led by James Aubrey Smith and John Leland Harvey. They seized dynamite nitroglycerine burglar tools and arrested Smith 33 Harvey 20 Elsia McCall 28 Lois Reid 21 Morria Twyman 24 Bettie Twyman ? Idohn Randall 30. A six week old infant of the Twymans was seized with the parents.
Columbia University announced a seven foot tank to generate large volumes of x rays for cancer research. The device, housed with Presbyterian Hospital, uses a vacuum interior and 6,000,000 cycles per second electrical input, aiming to probe deeper doses while considering cost and practicality for patients.
Robert Mails and Walter Legenza, infamous gangsters, were executed in the electric chair for the murder of E. M. Huband during a 1930s federal reserve truck robbery. Gov. Peery denied clemency as officials, chaplains, and juries watched in Richmond Virginia. Mails admitted presence at the holdup while Legenza maintained a stoic calm before the fatal procedure.
In Topeka on February 2 a San Antonio stenographer testified that Maj. Charlies A. Shepard looked guilty of poisoning his second wife Mrs. Zenana Shepard. She said her belief arose during cross examination as government evidence pointed to motive and premeditation. The witness recalled letters and gifts, including a $1,600 car, in the context of the suspect’s romance with Miss Brandon. The judge took no action to strike the remark, and the trial paused with a plan to resume Monday for the government’s closing.
A partial solar eclipse will be visible in the United States today with peak viewing between 1:11 and 1:25 a.m. in West Virginia. The event, the first such eclipse this year, will be observable in limited clear conditions before and after the peak time.
Flemington New Jersey February 2 1935 defense attorneys for Bruno Hauptmann say a key witness may refuse to testify claiming he was intimidated by men purporting to act for the state. A State Auditor review reveals justice of the peace costs far exceed judgments, with examples from Kanawha and McDowell counties. One judge billed 8.50 for a 1.00 judgment, another 8.50 for 3.47 and 2.75 judgments, while Mercer cases of 65, 52.70, and 86.99 saw only 0.08 0.40 and 20.01 costs. McDowell charged 19.50 on a 10 bill. Two Manhont counties added 6.35 and 14.28 18.10 costs. The auditor notes many judges solicit collections on letterheads, exposing pressure tactics.
