Washington Aug 12. A private effort by the National Recovery Administration to unite the diverse coal factions on a code for competition began as public hearings on industry demands concluded. Kenneth M. Simpson said this is the first time more than two codes faced hearings for a single industry. About 80 proposed codes have been filed with groups urged to appear on August 22 for a conference to craft a nationwide or regional code.
Sheriff Thomas B. Bush used a riot gun to kill two assailants and wound a third during a confrontation tied to Chicago fugitive Ferris J. Anthon. Police identified gunmen Sam Scola and Gus Fanone, linked to night clubs and a political racketeering group run by John Lazin. A ballistics expert noted the fatal bullet came from a 46 caliber automatic pistol.
H Wiles of Huntington was named assistant chief engineer of the state road commission in charge of secondary road locations. Commissioner Ernest J Bailey announced the appointment along with 27 in the automobile bureau 5 in accounting 2 janitors 39 assistant supervisors on primary roads and 28 on secondary roads. Six appointees to the anti Mobile bureau are from Kanawha county. The list includes Miss Flossie Butts Dallas Bouchelle Madison Gardner Miss Nello Givin Claude Saunders and Allen Tempte. Edgear Dickson of Monroe county named secretary of the automobile bureau. Others named are Elizabeth Blod Randolph county A G Mathews Jr Calhoun county R L Reinhart Jefferson county.

Jackson county prosecutors and defense counsel hurried to ready their murder case presentations for a Jackson County jury to be drawn Tuesday. Subpoenas for about 20 witnesses were prepared by Prosecuting Attorney Carter W. Stents. Three men face charges in the killing of Roy Shamblin near Koons Jackson County on July 25. Leo Fravier Charles Harper and Henry Cana are charged with murder. Latise Fravier and Elizabeth Maria face accessory before the fact counts. The accused were jailed in Charleston and await scrutiny as judges and prosecutors prepare to present the case in Ripley with Sheriff R. C. Andrews and state witnesses assisting.
A local woman described as deeply interested watches two murder trials in Ridge court. The cases involve suspects in the burning of her mother's residence and the death of Roy L. Shambhin, deputy sheriff, with another murder trial to open in Jackson county next Tuesday.
W L Mercer of Charlestown, 32, died when his EB D Frump Transport beer truck loaded with 325 cases overturned on a steep decline near Bull's Creek. A prior fatality occurred last April when Edward Wallet, 50, riding a beer truck, was killed in a capsize nearby. Mercer’s body was removed to Charleston after extraction and funeral arrangements are pending.
In St Paul Minnesota authorities announce indictments under the Lindbergh kidnap law against four Chicago mob figures tied to the Touhy gang Roger Touhy and henchmen face charges of kidnapping William Hamm Jr. at the Theodore Hamm Brewing Co. in St Paul. The indictments accuse conspiracy to kidnap for ransom and interstate transport of persons held for ransom.
West Virginia bituminous coal output for the week ended July 29 reached 2,370,000 tons, up from 2,187,000 the prior week and 1,514,000 a year earlier. Southern district produced 1,810,000 tons and the northern region 580,000.
Twenty three mandamus petitions filed in the West Virginia Supreme Court seek to compel 15 counties to levy taxes on all taxable property to pay bills for road and bridge work and machinery use. The court set September 7 as the return date. Six contractors are petitioners. the Cabell County taxpayers’ association seeks an injunction against Huntington’s special levies.
Rome reports the completion of Italo Balbo's transatlantic seaplane squadron's return from a six week voyage to Chicago World's Fair. The fleet landed at Fiumicino near Ostia amid loud welcomes after an 11 hour leg, Mussolini greeting officers as celebrations begin for the historic flight.
Mrs. Franklin D. Roosevelt visits White Top Mountain Virginia to meet elders and mountaineers. The White Top folk festival features crack singers and cloggers competing for prizes while Mrs Roosevelt recalls her father Eliott Roosevelt and his friends. She meets John Smith 78 and two Trigg children associated with 1893 performances.
The Charleston Gazette announces that starting tomorrow its employees will work a forty hour week as recommended by the American Newspaper Publishers Association code. The paper seeks approval from General Hugh S. Johnson, national recovery administrator, and pledges cooperation with President Roosevelt’s national prosperity plan.

An intermediate court jury failed to reach a verdict after more than an hour in the arson murder trial of William Pumpkin Bill Price and William Bruce. They allegedly set a Lens creek house fire in September 1931 causing the death of Mrs. Dryden Stone. Prosecution and defense argued over witness intimidation claims as Roy James testified from Maundertie prison.
Aug 3 Havana street car workers join the strike of omni bus and taxi drivers amid protest against the government tying up transportation in the western part of the island. Aug 4 Machado brands the strife seditious and threatens martial law and a state of war to end it. The president orders the army to occupy the capital as disorders follow with 21 killed and about 150 wounded. Aug 18 Ambassador Welles tells Machado he must take leave.
Round Commissioner Batley issued calls for bids to be opened on August 24 for seven highway projects and on August 30 for seven bridge projects. The total estimated cost is 1,800,000 dollars, funded partly by a federal program of 4,474,000 dollars for West Virginia highway work. Minimum wage rates are set at 35 cents for unskilled and 45 cents for skilled labor under a recent increase aligned with the national recovery act, and bidders must use domestic materials. Road projects span Cabell Randolph and Ritchie counties with concrete and stone base work described for specific routes.

Havana reports Carlos Manuel De Cespedes, marking his sixty second birthday, assuming provisional presidency as exiled President Gerardo Machado flees to the Bahamas. De Cespedes, a former AP correspondent and scion of Cuban nobility, is described as tall in influence and fluent in six languages, with a history as army chief of staff and diplomat in Washington and Paris. The elder De Cespedes, revered as a nation founder, sparked Cuba’s early revolution from his Yara plantation in 1866.
