A federal judge in Birmingham refused to order desegregation but urged that Alabama’s pupil placement law be applied without discrimination. Judge Lynne found the plaintiffs had not exhausted remedies under the 1956 statute and warned that unconstitutional application could force a desegregation plan. He noted the district’s officials professed good faith while delaying injunctive relief.
