Suit claims Sunshine Street permit complies with rules
Bruce Berstler of Cedar Rapids sues Linn County seeking an unconditional building permit for a house on a 10 acre site just outside city limits. He argues the county zoning ordinance and building code are fully met and the conditions imposed to dedicate a 66 foot road strip and to locate the house 116 feet from the north boundary are unlawful. The county says the easement is needed for access to a public road and the conditions reflect county law. Berstler contends the zoning commission acted arbitrarily and the building official’s denial prompted the lawsuit.
