Iowa Supreme Court to Decide on Maximum Felony Penalty
A test case in Fort Madison prompts the Iowa Supreme Court to determine if judges may impose sentences below the maximum for felonies. District Judge Rankin ruled the court can fix sentence length beyond the indeterminate law, prompting an immediate appeal by Assistant Attorney General Lehan T. Ryan. If upheld, many life terms could be reduced to set terms, though past rulings favored maximum penalties.
