A three judge federal panel declared Iowa's major chain store gross receipts tax unconstitutional but allowed the occupational tax to proceed. In Yetter Indiana a house fire claimed the lives of 15 month old twins Zyltha and Zelda Van Ahan, who were sleeping in a crib when neighbors rescued them from thick smoke. Their mother had just visited her mother and was away during the blaze. The Van Ahan family includes three other children.

Dayton AP report states Leslie Tower, famed Seattle test pilot, died in hospital at 6 07 p m Tuesday from injuries suffered October 30 in the crash and burn of the army Flying Fortress. He had a blood transfusion Sunday night and rallied briefly.
Former Woodbury County Attorney Max E. Duckworth was jailed for contempt after refusing to testify in the gambling conspiracy trial of Iowa Attorney General Edward OConnor. Judge Earl Peters held him in contempt and ordered jail until he agrees to answer. Duckworth plans a supreme court review.
President Roosevelt named Seth Thomas of Fort Dodge to the eighth federal circuit court of appeals in St. Louis. He succeeds retiring Judge Charles B. Faris, following the line of former Fort Dodge attorney and former Iowa senator William Kenyon. Thomas had been solicitor for the Agriculture Department and guided AAA shifts after Jerome Frank's departure, resigning after the Hoosac Mills case and living in Fort Dodge since.
