In Des Moines Polk County Attorney Ed Thayer opened the first degree murder trial of 17 year old Tommy Ellis by presenting that witnesses would testify he signed a statement detailing the killing of 85 year old Flora Bryan. Thayer said Ellis was seen near and in her home on February 4 and described Mrs Bryan as unable to defend herself. He said Ellis killed her to obtain money to leave Des Moines. The jury of eight women and four men was seated after lengthy voir dire and the panel showed mixed views on the death penalty.

In a damage case against the All Iowa Agricultural Association, four of the original 33 plaintiffs admit they authorized their names in the petition while the Harpers and Robinsons pursue withdrawal. The suit, over alleged nuisance from Hawkeye Downs races, names multiple attorneys and seeks $37,500 in damages.
On Monday two wills were admitted to probate. Al bie S. Prochaska who died May 14 names Robert W. Kroupa and Anna F. Kinga as executors without bond. Oldrich Truhlar who died May 5 names Mollie Truhlar Yuza as heir and executrix without bond and leaves 500 dollars to Lumir Truhlar and Beatrice Koch.
A total of 530.48 was awarded to Mercy Hospital Monday in two account suits. Judgments were 242.97 against Ray and Mary C Schoenberg and 287.51 against Nelson and Esther Hamman.
Lester Maurer brought a promissory note suit against Jacobs Photo Shop and Mr and Mrs Jack Locke which was dismissed with prejudice by the plaintiff on Monday.
Davenport police report Charles A. Brandt 27, of Davenport collapsed while driving this morning and died at Mercy Hospital after arriving there by ambulance. No suspects or foul play indicated. investigation ongoing.
Charley Ellis Potter died in a Cedar Rapids nursing home after a long illness. Born January 18 1867 in Marengo he was an engineer and fireman for the North Western Railway for 60 years. Survived by son Sam Potter Clinton son Noel daughter Mrs Maxine Bell brother Thomas of Chicago sister Anna Engel and several grandchildren. Funeral services were set for 3 30 p m Wednesday at Snell funeral home Clinton with burial at Springdale Cemetery.

Pfc James Richard Van Antwerp who fell in Germany on April 26 1945 will be given services in Beatty chapel Thursday June 1 at 1 30 p m. The body reaches Cedar Rapids May 31 and burial will be at Linwood cemetery. He is survived by parents Mr and Mrs Mark C Van Antwerp of Wichita Kansas and two brothers Mark C Van Antwerp Jr of Anamosa and Jess of 1056 Center Point road NE.
Mrs Minnie Fink aged 71 of 409 Twenty second street SE Cedar Rapids died at home at 7 a m after a brief illness. She was born in Jones county May 21 1879. Survived by son Nelson Fink and sister Mrs Tena Melton both of Cedar Rapids. Services in Beatty chapel time to be announced. Burial in Lisbon. Friends may call after 3 p m Wednesday.
Funeral services for Mrs Lena Gatto of 1542 Fourth Avenue SE are scheduled Wednesday at 9 a.m. at Immaculate Conception Church with Rt. Rev. J. M. Molloy officiating. Burial follows at Mount Calvary Cemetery. Msgr. Molloy will lead the Rosary Tuesday at 8 p.m. at Monahan Funeral Home, where friends may call.

Iowa City engineer Fred Gartzke will present a report on a 107 block asphalt street resurfacing program. The project costs about 143,906 dollars and was proposed by Alderman Charles Smith who suggests funding via bonds against Iowa Citys share of state road taxes.

The Cedar Rapids Board of Review disposed of two protests this year with one property assessment decrease for Royal Atelier Company and one denial for Ernest Kosek. The decrease followed a correction of a misassigned asset, while the denial rested on a city attorney opinion that no valuation change since 1949 allowed adjustment. The board also granted two tax cancellations for residents unable to pay due to infirmity. A final meeting is set for May 31 with records being updated afterward.

Verne E. Barker 31, recaptured escapee from Story county jail Nevada, will be sent to Fort Madison penitentiary to serve up to 10 years. In Nevada district court Judge H E Fry sentenced Barker after guilty pleas to auto theft jail break and escape. Fry gave Barker up to 10 years on auto theft and one year on jail break and escape plus five months of a six month county jail term for a larceny charge.
