The National Labor Relations Board ruled the Wilson plan and the employees' representative committee as the bargaining structure, calling it the successor to a prior plan tied to company domination. It rejected claims that the CIO United Packinghouse Workers union was impeded from organizing and that the company threatened plant closure if CIO led representation.
